Live Blog - Bill C-6, Part 7
Posted By Senator Elaine McCoy Dec 10 2009 02:03PM

OK folks.  Here we go!

4:10pm:  Senator Martin rises to move 3rd reading.  She gives the same rationale as before -- global marketplace, same protections as the US and UK etc., etc.  "Canada may become a dumping ground for defective products" unless we pass the bill as it is.

4:21pm:  Senator Day speaks about the problems with US legislation.  He also says we should not try to force passage of a bill by fearmongering.  Dead babies should not be used as a debating device.

Senator Day goes on to rebut allegations he is against mandatory reporting and recalls.  He ends by predicting trouble with the legislation in the future.

4:31pm:  Senator Furey, offers an eloquent argument for protecting the privacy of home owners.  He urges his colleagues to not be lulled into a place of complacency; he says that we must stand up to protect the privacy of Canadians.  He receives much applause from senators.

He goes on to say that while other acts have similar provisions for home entry, this legislation does not have the same restrictions.  One example is that the entry has to be related to an offense.  However, with Bill C-6,  the inspector has extraordinary home entry powers.

“Everybody in this country is not a criminal, everybody in this country is not a nuclear scientist, but everybody is a consumer!”

This is not an innocuous statute.

Senator Furey puts forward an amendment to protect the privacy of Canadians.  Now we debate the amendment.

Up now Senator Yonah Martin.

4:44pm:  Senator Martin suggests that Senator Furey is not up to date on the proceedings of the committee and therefore his analysis is incorrect.

4:55pm:  Senator Baker is now speaking to Senator Furey's amendment.  He is v. complementary of his colleagues and their abilities.  Specifically he tells us about his respect for Senator Keon.  He reminds us that Senator Keon believes that while this bill is not perfect, it is about the safety of Canadians, so therefore must get on with it.

Senator Baker is taking a much needed light approach.  He is backing up Senator Furey, to say “a man’s home is his castle”.

5:05pm:  Senator Baker is quoting on police and home entry which we will post tomorrow.

5:19pm:   Senator Keon expresses his worry that there is too much of a delay when it comes to acting upon hazardous consumer products.  He believes that if this legislation is delayed or does not pass that a lot of people will be harmed before we can put through another bill.

5:20pm:  Senator Furey reminds the chamber that no one wants to see anyone get hurt.   But he reminds us that with his amendment, we can keep our children safe AND protect the privacy of Canadians in their homes.

5:23pm:  Senator Carstairs tells her colleagues that Senator Furey’s amendment is minor, just two words, but it has great significance.  She says that every citizen deserves to have their rights protected and this amendment can do that.

5:33pm:  Senator Banks is now before us.  As ever he is eloquent and concise.  He is putting forward his amendments.  The first is with respect to the disclosure of personal information to a person  or government.

Gwen here on behalf of Senator McCoy:

5:38pm:  Senator McCoy asks Senators to induldge her in an exercise.  She asks the Senators to sign their name to a piece of paper....she tells them to keep writing, and while they are writing, to scratch their nose at the same time.  She applauds the Senators for being able to do both actions at the same time.  This exercise was to illustrate that we can do both actions and honour the needs and purpose behind each act at the same time.

She believes that we can accomplish the same with this legislation.  We can protect civil liberties while at the same time enforcing the law.

After Senator Bank's and Furey's amendments, Senator McCoy will not put forward her amendment .

6:01pm:  We are going to adjourn until 8pm:.....

Check it out exactly what the amendment changes are and who voted what way

Election in offing

So speak to your MP's because they have to deal with these changes now

We just get another chance to continue the fight

But This time

Address the two schedules Items

Schedule "restricted Usage" no matter how dangerous (toacco kills 47,000 Cdns every year) is a legal product with and Act (tobacco Act) that exempts them from the HPA and CCPSA

Schedule "Banned Absolutely" has no exemption Acts as Health Canada and Other Ministries did not communicate and work to make the Act for those Banned absolutely products no matter how safe they are

(UFFI Health Canada Ghost Health Hazard, no danger) but HPA_CCPSA is a killer legislation

Best Wishes for the Holiday Season to One and All

As sovern person I will not comply to such terrible writen statutes and acts. In my opinion, those that support this bill either are in support of circumvanting my rights and making Canada into a fascist state under the control of world governence lead by leaders un-elected by the people in the country or they are ignorent of the facts or simple not able to comprehend them. It is clear to me that this kind of power in the hands of the department of health is unwarnentted and unessary. The Minister has more then enough powers to protect and warn Canadians of the issues at hand, I feel that the this is a political ploy to distract Canadians from the fact that the Minister has failed to use that power and not used correctly. I also feel that the Minister should resign and that Bill -C6 should be scrapped. I also feel the Minister is listing to the will Multination drug company lobbiest and not the will of Canadians. I am ready to go to an election over this issue any time!

It is now the time Canadians are waking up to the decite and lies , and are shifting there conscious awareness to the truths and facts. We will not comply or let this continue any more.

Concerned Canadian!

Here's a letter I sent to a local paper regarding Vic Toews article about Liberal senators blocking a safety oriented bill.  He doesn't even mention Bill C-6 in his article.

Liberal Senators are Protecting Canadians from Regulations Illegal under our Charter of Rights and Freedoms

MP Vic Toews is complaining about the Liberal Senators blocking Bill C-6.  Bill C-6 strips ordinary citizens of their right to a day in court.  Bill C-6 gives government inspectors the right to trespass, to seize property and to levy fines without a court order, and to use lethal force in the process.  Bill C-6 strips an elder from giving a traditional medicine to a family member if an inspector deems it unsafe.  The only recourse a citizen has if such draconian laws are imposed on them is to beg mercy of the Federal Minister in charge of the department.  What about our day in court?  Doesn’t a criminal with a gun get a day in court?  Why not a day in court, should your product be deemed unsafe by a federal inspector?

Where are our Charter Rights going?  Why do the feds need such all encompassing powers that will trample the freedoms we enjoy here in Canada?  The Department of Health says they want these laws to protect us. Mr Toews mentions lead in toys, and other consumer concerns.  What he doesn’t mention is the Department of Health’s drive to eliminate natural health products that would fall under this legislation (which we are already losing under current legislation).

The senate committee reviewing Bill C-6 had an opportunity to listen to Shawn Buckley, a constitutional lawyer who once worked for Health Canada convicting natural health practitioners.  He soon realized that he could only get them on procedural and regulatory issues, and that they were helping Canadians get well, and mainly those who were not being helped within our medical system.  Shawn now is working on the side of natural health practitioners and has explained to the senate quite clearly why Bill C-6 is not only unconstitutional, but will bring harm to those who are currently benefiting from natural health products.  The feds do not need the powers that this bill will give them.  The powers they have now are already eliminating many natural health products that are helping people.  This nonsense has to stop, and the Senators, our sober second thought to impending laws, are doing their job by questioning, changing and hopefully rejecting Bill C-6.

For a lengthy and detailed accounting of this whole issue go to Shawn Buckley’s website.  Search “Charter of Health Freedom” to get the big picture on the damage that the feds are trying to impose on Canadian’s freedoms and on our health care choices.

Bill C-6 is frightening in its ability to transform this nation.  And we are not the only ones suffering this assault on sovereignty, both national and personal.  This URL goes to an article in the London Telegraph:

http://www.telegraph.co.uk/finance/comment/ambroseevans_pritchard/6744787/Its-a-return-to-the-Star-Chamber-as-Europe-finally-tramples-Magna-Carta-into-the-dust.html

Unfortunately, this is reflective of current legislative practice here in Canada, that rights and protections are being subverted to some vested interest over which we have no control and no vote.  Senator McCoy, you have been one of the shining lights of liberty for all Canadians in these deliberations, and we thank you.  However, it is apparent that all Canadians need to pick up the banner and voice their disapproval of any legislation which is deleterious to our inviolable rights as citizens of this nation.  This Bill has seen manipulation of the committee testimony as well as interference from the Lower House.  What is the hurry?

We are watching these proceedings with bated breath.  Will the Bill still be sent back to the House for "sober second thought"? Or has Harper felled that idea as well?

GO, ELAINE!!
